Kim McMenamin, an acupuncturist from Buncrana, County Donegal, shared "defamatory and malicious" comments about Mr. Casey with his 2,000 Facebook followers, according to the High Court.
In his campaign for the Irish People Party this year, Mr. McMenamin identified himself as an activist against mass immigration, austerity, and lockdowns.
Following Mr. Casey's decision to turn a home he owned in Ludden, Buncrana, into lodging for women and children escaping the conflict in Ukraine, the position was created.
Mr. McMenamin had voiced "serious opposition" to the idea of "non nationals" visiting the town and county, according to Mr. Justice David Nolan.
He shared on Facebook on April 25, 2023, that he and other others had visited the Ludden property and told the employees that "moving unvetted people around like cattle and then warehousing them in office cubicles for profit is akin to human trafficking and inhumane."
Additionally, Mr. McMenamin urged people to spread the word about the post. According to Mr. Casey, the position implied that he treated individuals like animals and engaged in activities similar to unlawful human trafficking.
On May 11, 2023, the property was devastated by fire. The "main media outlets" failed to disclose the fire, according to a Facebook post by Mr. McMenamin.
According to Judge Nolan, there was no evidence shown in court that Mr.
McMenamin was responsible for the fire. He stated that it appeared like Mr McMenamin was "very anxious" about the building's damage being disclosed.
Judge Nolan stated that Mr. McMenamin did not make an appearance or take any action to defend his position following Mr. Casey's filing of a defamation lawsuit. A date for a hearing to determine damages was set, and a judgement was issued in default of appearance.
The High Court permitted the order to be served by pinning it to Mr. McMenamin's door or gate, the court noted, because he had escaped service of the proceedings.
